Within these Terms of Service “We” or “Us” refers to Appartamento 57 or APT57 of PO Box 221 Rose Bay, New South Wales 2029. And “You” or “Your” refers to you – the visitor, user or customer. The Terms of Service stated here incorporated with your order establishes the unmitigated Contract between APT57 and You for the supply of items. The Contract cannot be modified unless we agree to modify the Contract in writing or by email.
Your Account and Information:
Please refer to our privacy policy for further information regarding Your personal and or usage data. We do not store any Credit Card or Financial Information on, or within this site.
Shipping:
Please refer to our Shipping Info page for further information regarding both Shipping Destinations and Delivery Services utilised.
Legal Scope:
If you are under the age of eighteen [18] years, you are not permitted to Order items form this Website.
By agreeing to these Terms you confirm that you are of, or above the age of eighteen [18] years. If APT57 were to encounter any loss or damage from a proceeding entered into by a minor APT57 reserves the right to seek compensation for such losses from the legal guardian of the minor who generated any Order/s which have been transacted with APT57.
Establishing Your Order;
All prices stated on APT57’s website are in (AUD) Australian dollars.
You can establish an Order by completing our Order Form provided within the APT57 website and pressing the “Place Order” button. After you place an Order, you will receive an Order Number via email from APT57.
By placing an Order, you make an offer to APT57 to buy the Item/s included in Your Order established within these Terms and Conditions. Data included within the APT57 website aggregates an invitation to treat. No data on the APT57 website aggregates or shall be assumed as an offer by APT57 to provide any Items.
APT57 will advise You, that Your Order is being prepared by emailing You an Order Confirmation and an Order Total Summary Reminder. Notwithstanding, APT57 does not formally welcome Your offer in advance of our internal vetting policies to which, legitimise each order submitted. This process is conducted to mitigate unauthorised payment and or credit card fraud.
APT57 reserves the right to terminate services, orders or accounts and remove data at its absolute sole discretion. APT57 will substantiate approval of your Order by emailing You shipping confirmation of the Items you have Ordered. If We are unable to proceed with, or approve your Order after payment is received we will promptly advise you via email.
Payment Proceedings:
APT57 currently accepts Direct Deposit to the account stated within the Check Out process.
APT57 in its sole discretion will determine whether payment will be accepted or refused. We may contact via phone or email to request additional identification to verify your identity to approve your order.
You will be advised after Your order has been reviewed and approved via email. The processing of payment will only begin once APT57 has received all information required to legitimise and approve the order made.
Trade and Order Processing;
Orders placed on Saturday, Sunday and Public Holidays will be processed the following business day. Business days are Monday to Friday however this does not include week days which fall on public holidays.
Payments are processed after we have received funds. When Your order has been approved and processed We will then send you an email informing You that Your order is being made ready for dispatch. Once dispatch has been made You will receive an additional email quoting Your tracking number and an invoice for items included in Your Order.
Fraud
Deposits to Accounts and Use of Credit Cards from unauthorised persons:
APT57 employs SSL (Secure Socket Layer) technologies within our website for transactions between us and you, our website users and patrons.
You agree that APT57 will not be responsible for any losses or consequential damages (direct or indirect) that are a result of unauthorised or fraudulent account or credit card usage.
Fraud prevention;
APT57 withholds the right to contact you and request additional forms of identification to verify you as a legitimate customer prior to an order being approved and processed for dispatch. These forms of ID may include a copy of the credit card being used and your current, valid driver’s license or passport.
In the case that you choose not provide these additional forms of ID to verify your identity, you accept that APT57 has the right to cancel your order and refund monies to the method from which the transaction was placed.
Presentation;
You agree that whilst APT57 provides You with the most accurate depiction of the items that is possible, each and every device displays site content and colours differently. Also, You understand that We cannot guarantee You are viewing products presented with full accuracy and as such we
take no responsibility for the choices made within your Order or the resulting viewing differences created by various devices.
Transit;
You agree that it is the responsibility of the delivery service utilised and not that of APT57 to provide safe and successful delivery of items ordered by you.
You agree that APT57 bears no liability for damage or loss of ordered items proceeding the dispatch of an Order, effective immediately after the item has left the possession of APT57.
Pre-owned items
You understand and agree with APT57 that Pre-owned items Ordered are second-hand goods and you are aware of their current condition.
AGENCY;
You understand that APT57 is the Vendor’s Agent of Sale and is not the owner of the goods being ordered.
You understand that as the Vendor’s sole Agent APT57 claims Limited Title to this item.
RETURNS;
You understand that exchange, return of, or refund for Pre-owned items are not available from APT57 unless within the scope of Australian Consumer Law.
YOUR DUTY OF CARE;
You understand that items ordered from this website require regular special care, maintenance and professional services to maintain their high quality and durability and you agree that your offer to purchase any Pre-owned item via APT57 has been made with these factors in mind.
You understand that repair facilities, spare parts or professional services are not available through APT57 for Pre-owned items.
You agree that you did not rely on the APT57’s skill or judgment when Ordering items.
You agree with APT57 that the item is free from hidden defects and is of acceptable quality and is reasonably fit for its intended purpose.
You agree that APT57 bears no liability for degradation of ordered items proceeding the dispatch of an Order, effective immediately after the item has left the possession of APT57.
PRE-OWNED ITEM AUTHENTICITY;
If an item APT57 presents is proven to be non-authentic – we offer a full money back guarantee.
PRE-OWNED ITEM CONDITION
APT57 has a 4 level ranking;
Immaculate – 5 star and item presents with little to no indication of use, damage or augmentation.
Very Good – 4 star and item presents as undamaged, with minor indications of age and use.
Good – 3 star and item presents with visible indication of age and general usage however, it does not display any visible damage or augmentation.
Vintage – In Good Condition however, special care, maintenance and professional service will be regularly required for this item. An offer to purchase this item should only be made with these factors in mind.
PRE-OWNED ITEM PRICING;
During an items listing on this website APT57 reserves the right to update or amend the price of any item – at any time, prior to an order being placed.
Updates and Amendments;
APT57 reserves the right to update or amend these Terms of Service at any time, at its sole discretion.
Governing law;
The Terms of Service stated here are governed by the laws of New South Wales, Australia.
